  4.      Should the premises or any portion thereof be leased, SELLER 
  5. shall provide to the BUYER either a copy of and any all leases in 
  6. effect, or, should there be any tenants in possession without 
  7. current written leases, the SELLER shall provide estoppel letters 
  8. at least 5 days prior to closing stating that there is no lease 
  9. and the duration of any verbal lease, and the terms of the verbal 
  10. lease.

  13.      All taxes for the current year, escrows on mortgages assumed 
  14. by the BUYER, prepaid insurance on policies assumed by BUYER, 
  15. homeowners association dues, shall be prorated between the 
  16. parties as of the date of closing.

  19.      At the time of closing SELLER shall provide an affidavit to 
  20. BUYER that either:
  21.  
  22.  
  23. a) there have been no improvements made which would subject the 
  24. property to the filing of mechanic's, materialman, labor or other 
  25. such liens; or
  26.  
  27.  
  28. b) that there were improvements made to the subject property and 
  29. all persons having the right under law to lien the property were 
  30. paid or lien waivers obtained.

  33.      The SELLER represents to the BUYER that the present use of 
  34. the property is lawful and complies with all zoning, governmental 
  35. regulations and restrictive covenants and other similiar 
  36. contracts in effect.
